Man charged with DUI in Florida

A father and his girlfriend are facing serious charges after the death of his two sons following a car accident on Nov. 25. The Florida man has been charged with DUI in connection with the tragic crash, and his girlfriend faces charges of allowing an unauthorized operator to drive. The two children, aged 7 and 10, both died after their father reportedly crashed his vehicle into a canal.

According to the accident report, Cape Coral police responded to reports just before midnight of a vehicle that had gone off the road and into a canal. Good Samaritans and first responders on the scene reportedly attempted to save the two children by jumping into the water, but both boys were pronounced dead on site. Police believe the father and his girlfriend may have exited the vehicle while leaving the children inside.

It is not clear why officers chose to charge the man with DUI as no record of roadside sobriety testing was mentioned. However, both he and his girlfriend were arrested. It is unclear whether they remain in police custody at this time or if they have been released on their own recognizance. No court date has been announced, and it does not appear that either individual has retained criminal defense counsel.

The deaths of children are tragic beyond imagination, but the justice system exists to ensure that their father is entitled to a fair trial that takes into consideration all the facts of the case. His criminal defense attorney will carefully review any evidence Florida prosecutors intend to bring forward in the DUI trial in an attempt to build a strong defense against these charges. It may be possible to see the charge reduced or even dropped altogether.
