Compassionate Intervention Through Guardianship
Whether the decline was sudden or gradual, your loved one is no longer able to manage their own affairs or personal care. In the absence of powers of attorney, you realize the time has come to ask the court to step in.
The Law Offices of Justin Rickman helps families in Central Florida establish guardianships. We understand that this is a hard decision and that your loved one may object. Our lawyer and staff offer compassionate support and sound legal counsel for these sensitive situations to help you protect your family member while preserving their dignity.
If your loved one did not designate a power of attorney and/or a health care proxy in their estate planning, you will have to petition the court to be appointed legal guardian. There are two main categories:
- Guardianship of property – This authorizes someone to manage the ward’s finances and investments, and to conduct business or legal transactions on their behalf.
- Guardianship of the person – This individual watches over the ward’s health care, residence, travel and general well-being. The guardian is authorized to hire help or seek placement in a nursing home or assisted living facility if and when the ward needs advanced care.
Guardianship is a big responsibility. We will make sure you understand the duties and legal obligations, including annual reporting requirements and court approval for certain actions. We will help you present evidence at the incapacity hearing and answer any questions about your fitness to serve as guardian.
Guardianship can be contested. The ward may not think they need oversight. Other family members may dispute the need for a guardian or the choice of guardian. Attorney Justin Rickman has experience in contested and uncontested guardianship proceedings in Lake County and surrounding jurisdictions.
Making A Difficult Process Easier
We recognize that guardianship is a sad but necessary step to protect loved ones from themselves or from unscrupulous people who would take advantage. We will guide you through the process and keep you informed at every stage.
