Guardianship Proceedings

If your loved one did not designate a power of attorney and/or a health care proxy in their estate planning, you will have to petition the court to be appointed legal guardian. There are two main categories:

  • Guardianship of property – This authorizes someone to manage the ward’s finances and investments, and to conduct business or legal transactions on their behalf.
  • Guardianship of the person – This individual watches over the ward’s health care, residence, travel and general well-being. The guardian is authorized to hire help or seek placement in a nursing home or assisted living facility if and when the ward needs advanced care.

Guardianship is a big responsibility. We will make sure you understand the duties and legal obligations, including annual reporting requirements and court approval for certain actions. We will help you present evidence at the incapacity hearing and answer any questions about your fitness to serve as guardian.
